1. Terms of Use

By accessing the website at https://enterkey.app or downloading and using the Enterkey mobile application ("the App"), you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the App or website. The materials and services contained in the App and website are protected by applicable copyright and trademark law.

2. Description of Service

Enterkey is a mobile application that enables users to manage apartment buzzer and intercom access from their smartphone. The App facilitates call forwarding and DTMF (dual-tone multi-frequency) tone generation to interact with building intercom systems without requiring hardware modifications. The service relies on third-party telecommunications providers to operate.

3. Account Registration and Eligibility

To use the Enterkey App, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 16 years of age to use the service. By creating an account, you represent and warrant that:

  • All information you provide is truthful and accurate;
  • You will maintain the accuracy of such information;
  • You are at least 16 years of age; and
  • Your use of the service does not violate any applicable law or regulation.
4. Acceptable Use

You agree to use the Enterkey App only for its intended purpose of managing buzzer and intercom access for properties where you are an authorized resident or have been granted access. You may not:

  • Use the App to gain unauthorized access to any building or property;
  • Share your buzzer access credentials with unauthorized individuals;
  • Use the App for any unlawful, harassing, or fraudulent purpose;
  • Attempt to interfere with, compromise, or disrupt the App's infrastructure or telecommunications systems;
  • Reverse engineer, decompile, or disassemble any portion of the App;
  • Use the App to make excessive or abusive calls that may disrupt telecommunications services;
  • Remove any copyright or other proprietary notations from the App or its materials; or
  • Reproduce, duplicate, copy, sell, or exploit any portion of the App without express written permission from Enterkey.
5. Telecommunications and Buzzer Access

The Enterkey App interacts with building intercom and buzzer systems through telephony services. You acknowledge and agree that:

  • Enterkey does not guarantee uninterrupted or error-free buzzer access, as the service depends on third-party telecommunications providers, cellular networks, and building intercom hardware;
  • You are solely responsible for ensuring you have proper authorization to use the buzzer access functionality for your building;
  • Call forwarding and DTMF functionality may be subject to delays, interruptions, or failures outside of Enterkey's control;
  • Standard messaging and data rates from your mobile carrier may apply when using the App; and
  • Enterkey is not responsible for any issues arising from building intercom hardware malfunctions or changes made by building management.
6. Use License

Permission is granted to download and use the Enterkey App on your personal device for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the App's materials or source code;
  • Use the App for any commercial purpose or for any public display (commercial or non-commercial);
  • Attempt to decompile or reverse engineer any software contained in the App;
  • Remove any copyright or other proprietary notations from the materials; or
  • Transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Enterkey at any time. Upon termination of this license, you must cease all use of the App and destroy any downloaded materials in your possession whether in electronic or printed format.

7. Subscription and Payments

Certain features of the Enterkey App may require a paid subscription. If you purchase a subscription:

  • You agree to pay all fees associated with your selected plan;
  • Subscriptions will automatically renew unless cancelled before the end of the current billing period;
  • You may cancel your subscription at any time through your account settings or by contacting us;
  • Refunds will be handled in accordance with the refund policies of the applicable app store (Apple App Store or Google Play Store); and
  • Enterkey reserves the right to change subscription pricing with reasonable notice to existing subscribers.
8. Disclaimer

The materials and services provided through the Enterkey App and website are provided on an "as is" and "as available" basis. Enterkey makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, Enterkey does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the App or its materials, or otherwise relating to such materials or on any sites linked to the website. Enterkey does not guarantee that the App will be compatible with all building intercom systems.

9. Limitations of Liability

In no event shall Enterkey or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption, inability to access a building, missed deliveries, or security incidents) arising out of the use or inability to use the Enterkey App, even if Enterkey or an Enterkey authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

10. Accuracy of Materials

The materials appearing in the Enterkey App and website could include technical, typographical, or photographic errors. Enterkey does not warrant that any of the materials are accurate, complete, or current. Enterkey may make changes to the materials contained in the App or website at any time without notice. However, Enterkey does not make any commitment to update the materials.

11. Links

The Enterkey App and website may contain links to third-party websites or services that are not owned or controlled by Enterkey. Enterkey has not reviewed all of these linked sites and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Enterkey. Use of any such linked website or service is at your own risk.

12. Termination

Enterkey may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Service. Upon termination, your right to use the App will immediately cease. All provisions of these terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Modifications

Enterkey may revise these terms of service at any time without notice. By continuing to use the App or website after changes are posted, you are agreeing to be bound by the then-current version of these terms of service. If we make material changes, we will make reasonable efforts to notify you via the App or email.

14. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of British Columbia, Canada, and you irrevocably submit to the exclusive jurisdiction of the courts in that province.
